International Criminal Law constitutes the international dimension of Criminal Law. This area is a specialized field encompassing core international crimes, transnational crimes, and international judicial assistance.
International Judicial Assistance
International Judicial Assistance is the process where the judicial authorities of one state perform certain acts on behalf of the judicial authorities of the requesting state. Extradition is the most frequently requested type of international judicial assistance. Extradition is a process with both judicial and administrative dimensions. During this process, it is possible for the person whose extradition is requested to be arrested or subjected to other judicial control measures. As Celil Aktaş Law Firm, together with our solution partners in different countries, we provide legal services to our clients in extradition processes and other international judicial assistance procedures.
Transnational Crimes
Transnational crimes are crimes that start in one country but have effects on other countries. The crimes of migrant smuggling regulated in Article 79 and human trafficking regulated in Article 80 of the Turkish Penal Code are prime examples of transnational crimes. However, transnational crimes are not limited to these. As various crimes, such as IT crimes, drug trafficking, or the crime of money laundering of assets derived from crime, can be committed from different countries, the examples of transnational crimes are increasing daily. Transnational crimes are difficult to prosecute as they involve the jurisdiction of different states. They may also necessitate recourse to international judicial assistance.
Celil Aktaş Law Firm, together with our solution partners in different countries, provides legal services to our clients in all processes related to transnational crimes.
International Core Crimes
International core crimes are: genocide, crimes against humanity, war crimes, and the crime of aggression. These crimes have developed and evolved in International Law, particularly since the Second World War. Today, the International Criminal Court (ICC) is the international court where these crimes are tried. However, since these crimes are also regulated in the criminal laws of states, they can be prosecuted outside the International Criminal Court. Article 75 of the Turkish Penal Code regulates the crime of genocide, Article 76 regulates crimes against humanity, and Article 77 regulates the crime of establishing an organization to commit these two crimes. Since these crimes are subject to Turkey’s universal jurisdiction (evrensel yargı yetkisi), it is possible to prosecute them in Turkey regardless of where in the world they were committed.
